A TradesByTru product may show how the owner personally approaches the market, including how she: - Identifies market conditions; - Determines whether an opportunity is worth considering; - Waits for confirmation; - Enters a position; - Places or evaluates risk; - Manages a position; - Exits a position; - Remains out of the market; - Reviews completed trades; - Trades or evaluates futures and forex markets; - Approaches prop-firm evaluations or funded accounts; - Approaches account scaling; or - Progresses toward or trades live capital. Purchasing a TradesByTru product gives you access to educational content. You are not purchasing a guaranteed trading strategy, guaranteed trading system, guaranteed signal, guaranteed setup, guaranteed payout, or guaranteed financial outcome. 4. NOT A SIGNAL OR TRADE-COPYING SERVICE TradesByTru is not offered as: - A trade-copying service; - An automated trading service; - A managed-account service; - A brokerage service; - An investment advisory service; - An account-management service; - Personalized financial guidance; - Personalized trade instructions; - A promise that TradesByTru will take a trade; - A promise that every market move will be discussed; or - An instruction that you should copy, mirror, or act on any trade. Any trade, setup, chart, entry, exit, stop, risk decision, management decision, or market observation shown by TradesByTru reflects the owner's own trading process. Nothing shown requires or directs you to: - Enter a trade; - Exit a trade; - Copy a trade; - Mirror an order; - Use the same entry; - Use the same stop loss; - Use the same profit target; - Use the same position size; - Trade the same instrument; - Trade the same account type; - Trade through the same broker; - Use the same prop firm; - Use the same trading platform; or - Take any financial action. You are solely responsible for your own trading decisions. 5. REAL-TIME, RECORDED, AND RETROSPECTIVE CONTENT TradesByTru content may be: - Recorded before publication; - Published after a trade is completed; - Presented as a replay; - Presented as a voiceover; - Presented as a trade recap; - Shared during active market conditions; - Shared near real time; - Shared after market conditions have changed; or - Created for educational demonstration. Unless a specific offer expressly states otherwise, purchasing TradesByTru content does not guarantee real-time market updates. Market conditions can change rapidly. Content may be delayed, incomplete, misunderstood, interrupted, unavailable, or viewed after a market move has already occurred. Remaining out of the market is a valid trading decision. Unless expressly stated in a specific offer, TradesByTru does not guarantee: - A minimum number of trades; - A minimum number of setups; - A minimum number of lessons; - A winning trade; - A particular entry; - A particular exit; - A particular holding period; - A specific profit target; - Coverage of every market move; - A replay for every trade; or - Any particular trading result. 7. FUTURES AND FOREX RISK Trading futures, forex, leveraged products, and other financial instruments involves substantial risk of loss. Leverage can increase both gains and losses. You may lose some or all of the money you trade. Depending on the financial product, broker, leverage, margin requirements, account structure, and market conditions, losses may exceed the amount you initially intended to risk. Trading results depend on many factors including experience, discipline, market conditions, account rules, risk management, execution, psychology, and individual decision-making. PERFORMANCE RESULTS, SCREENSHOTS, PAYOUTS, AND MARKETING MATERIAL TradesByTru may display, publish, or discuss: - Personal trades; - Winning trades; - Losing trades; - Profit-and-loss figures; - Trading-platform screenshots; - Screen recordings; - Simulated results; - Demo results; - Evaluation-account results; - Prop-firm results; - Performance-account results; - Funded-account results; - Live-account results; - Payouts; - Trading statistics; - Account-scaling goals; - Account-scaling progress; - Personal trading goals; and - Daily, weekly, monthly, or yearly results. These materials may be shared for: - Transparency; - Commentary; - Journaling; - Education; - Entertainment; - Documentation; - Social-media content; or - Marketing. SIMULATED, DEMO, EVALUATION, PROP-FIRM, AND LIVE ACCOUNTS TradesByTru content may involve: - Simulated trading; - Paper trading; - Demonstration accounts; - Evaluation accounts; - Simulated funded-level accounts; - Performance-based accounts; - Prop-firm accounts; - Firm-backed accounts; - Personally funded live accounts; - Live funded accounts; or - Accounts subject to drawdown, consistency, scaling, or payout rules. TradesByTru does not intentionally represent simulated, demo, evaluation, or prop-firm trading as personally funded live-capital trading. Terms such as "funded," "performance account," "prop account," or similar language do not necessarily mean that an account is a personally funded brokerage account. Displayed account balances may represent: - Simulated funds; - Notional buying power; - Conditional buying power; - Restricted buying power; - Firm-backed capital; - Capital subject to withdrawal restrictions; - Capital subject to performance requirements; or - Capital that is not personally deposited or freely withdrawable. PROP FIRMS AND ACCOUNT SCALING TradesByTru may discuss its owner's personal experience with proprietary-trading firms, funded-account programs, account evaluations, payouts, scaling plans, or live-trading progression. This content is educational and reflects the owner's own experience and process. Prop firms may impose rules involving: - Drawdown limits; - Daily-loss limits; - Consistency requirements; - Payout requirements; - Scaling requirements; - Minimum trading days; - Prohibited strategies; - News-trading restrictions; - Position-size limits; - Maximum account limits; - Copy-trading restrictions; - Inactivity rules; - Platform restrictions; - Account termination; - Data requirements; or - Execution requirements. These rules may change at any time. TradesByTru does not control any prop firm, broker, exchange, trading platform, or funded-account provider. TradesByTru is not responsible for your: - Evaluation failure; - Account closure; - Account termination; - Denied payout; - Delayed payout; - Rule violation; - Trading loss; - Platform issue; - Broker issue; - Prop-firm dispute; or - Failure to qualify for account scaling. You are responsible for reviewing and following the current rules applicable to your own account. 12. YOUR TRADING RESPONSIBILITY You are fully responsible for your own: - Trading decisions; - Account funding; - Position sizing; - Risk limits; - Entries and exits; - Stop losses; - Profit targets; - Instrument selection; - Broker selection; - Prop-firm selection; - Trading-platform selection; - Order execution; - Leverage; - Margin requirements; - Commissions and fees; - Taxes; - Prop-firm compliance; and - Trading results. TradesByTru does not: - Place trades in your account; - Control your brokerage account; - Control your prop-firm account; - Manage your money; - Take custody of your funds; - Request your brokerage password; - Request your trading-platform password; - Request authentication codes; - Guarantee order execution; or - Guarantee that your results will match TradesByTru results. Never provide TradesByTru with sensitive brokerage, banking, trading-platform, or authentication credentials. You should trade only with capital you can afford to lose. Money needed for essential living expenses should not be used for speculative trading. 13. MOBILE TRADING TradesByTru may demonstrate trading using a mobile phone, mobile application, tablet, desktop platform, web platform, or other device. Mobile trading is presented as part of the owner's personal workflow. TradesByTru does not guarantee that: - Mobile trading is appropriate for you; - Every broker or trading platform supports the same features; - Mobile execution will equal desktop execution; - Internet connectivity will remain uninterrupted; - Notifications will arrive on time; - Orders will execute at displayed prices; or - A particular mobile device, broker, or platform will perform reliably. You are responsible for understanding your own trading platform and device before placing financial transactions. 14. PURCHASES, PRICING, MEMBERSHIPS, AND SUBSCRIPTIONS TradesByTru may offer: - One-time digital purchases; - Courses; - Educational programs; - Digital downloads; - Limited-access products; - Lifetime-access products; - Memberships; - Monthly subscriptions; - Recurring subscriptions; - Bonus content; or - Promotional offers. Prices and material purchase terms will be presented on the applicable sales page or checkout page. A one-time purchase does not create a recurring payment obligation unless clearly disclosed before checkout. If TradesByTru offers a recurring subscription or membership, the recurring nature of the purchase, billing frequency, price, and available cancellation method will be disclosed before purchase. Payments may be processed through third-party payment, checkout, subscription, or digital-product platforms. TradesByTru does not directly store complete payment-card numbers or payment-card security codes. By completing a purchase, you authorize the applicable charge or recurring charges clearly disclosed before purchase. 15. PRODUCT ACCESS AND UPDATES Access length may vary by product. Unless expressly promised as part of a specific purchase, the purchase of an existing product does not guarantee access to every future TradesByTru product, course, service, or program. 16. BONUS CONTENT TradesByTru may provide bonuses, including educational material related to: - Prop firms; - Account scaling; - Futures; - Forex; - Live-trading progression; - Trading psychology; - Risk management; or - Other trading topics. Unless a specific offer states otherwise, bonus content may be updated, replaced, added, removed, or discontinued at TradesByTru's discretion. A bonus is supplemental to the primary purchased product and does not create a guarantee of trading success, funding, payouts, account scaling, or profitability. 17. CANCELLATIONS AND REFUNDS Any refund, cancellation, credit, or access terms stated on the applicable checkout page, product page, course page, membership page, or third-party platform are incorporated into these Terms. Those purchase-specific terms control where they conflict with a general provision in these Terms. Unless a specific offer or applicable law states otherwise, the following are not by themselves grounds for a refund: - Choosing not to view purchased content; - Failing to use the product after access was provided; - Disagreeing with the owner's trading process; - Experiencing a losing trade; - Failing a prop-firm evaluation; - Losing a funded account; - Being denied a prop-firm payout; - Failing to achieve account scaling; - Failing to achieve similar results; - Deciding trading is not appropriate for you; - Changing your trading strategy; - Changing brokers or prop firms; - A market behaving differently than expected; - Your decision to copy or act on content despite these Terms; or - Technical problems caused by your own device, internet connection, account settings, or third-party services. Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law. 18. PERSONAL USE, RECORDING, COPYING, AND SHARING Paid TradesByTru access is personal, limited, revocable, and non-transferable unless an offer expressly states otherwise. Unless TradesByTru expressly authorizes it, you may not: - Share paid access links; - Share passwords or credentials; - Allow another person to use your paid access; - Screen-record or record paid content for redistribution; - Scrape or systematically archive paid content; - Restream or rebroadcast paid content; - Upload paid content publicly; - Publish paid content; - Redistribute paid content; - Sell or sublicense paid content; - Commercially exploit paid content; - Copy substantial portions of courses, videos, written materials, charts, screenshots, or trade breakdowns; - Use TradesByTru content to operate a paid signal service; - Use TradesByTru content to operate a trade-copying service; - Republish TradesByTru content inside another course, membership, website, social-media account, channel, or community; or - Circumvent access controls or security features. Downloading or saving content for personal reference is permitted only where TradesByTru or the applicable platform makes that functionality available. Any permitted download remains for your personal, noncommercial use. 19. INTELLECTUAL PROPERTY Unless otherwise stated, TradesByTru owns or has the right to use its: - Brand name; - Logos; - Written materials; - Educational frameworks; - Commentary; - Graphics; - Charts; - Videos; - Screen recordings; - Course materials; - Screenshots; - Trade breakdowns; - Lessons; - Digital products; - Recaps; and - Other original content. Your purchase grants you a limited, personal, revocable, non-transferable right to access purchased content according to the applicable offer. Purchasing a TradesByTru product does not transfer ownership of TradesByTru intellectual property. You may not reproduce, redistribute, sell, sublicense, publicly display, commercially exploit, or create a competing commercial product using TradesByTru content without written permission. 20. THIRD-PARTY PLATFORMS TradesByTru may use third-party services for: - Payments; - Checkout; - Digital-product hosting; - Course hosting; - Membership access; - Messaging; - Email; - Social media; - Marketing automation; - Video hosting; - Charting; - Trading platforms; - Market data; - Brokers; - Prop firms; - Website hosting; - Analytics; or - Customer support. Your use of third-party platforms may also be subject to those providers' terms and privacy policies. TradesByTru does not control third-party platforms and cannot guarantee: - Continuous availability; - Notification delivery; - Market-data accuracy; - Order execution; - Message delivery; - Media quality; - Platform performance; or - Continued availability of any third-party service. Temporary outages, delays, platform changes, account restrictions, service interruptions, or service discontinuations may occur. 21. THIRD-PARTY NAMES AND BRANDS TradesByTru may reference or display third-party: - Brokers; - Prop firms; - Trading platforms; - Exchanges; - Market-data providers; - Charting services; - Software; - Financial products; - Indexes; or - Other companies or trademarks. These references may be used to describe the owner's trading process or experience. Unless TradesByTru expressly states otherwise, no sponsorship, endorsement, affiliation, partnership, or agency relationship is implied. 22. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, TradesByTru is not liable for trading losses or financial decisions you make based on, after viewing, or in connection with the Services. To the fullest extent permitted by applicable law, TradesByTru is also not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from: - Use of the Services; - Inability to access the Services; - Trading losses; - Prop-firm losses; - Evaluation failures; - Denied payouts; - Account closures; - Third-party platform failures; - Notification failures; - Message delays; - Market-data issues; - Broker issues; - Execution issues; or - Unauthorized reliance on TradesByTru content. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. 23. SUSPENSION OR TERMINATION OF ACCESS TradesByTru may suspend, restrict, or terminate access where reasonably necessary to address: - Fraud or suspected fraud; - Chargeback abuse; - Unauthorized access sharing; - Account sharing; - Recording or redistribution; - Scraping; - Copyright infringement; - Harassment or abuse; - Security threats; - Platform misuse; - Material violations of these Terms; or - Legal or platform requirements. Termination resulting from your material violation of these Terms does not automatically create a right to a refund except where applicable law requires otherwise. 24. CHANGES TO SERVICES TradesByTru may change or expand its: - Markets traded; - Trading instruments; - Trading platforms; - Brokers; - Prop firms; - Account types; - Educational content; - Product formats; - Course formats; - Membership formats; - Pricing; - Features; - Content-delivery methods; or - Business model. For example, TradesByTru's personal trading may evolve between futures, forex, proprietary-trading accounts, and personally funded live accounts. Such changes do not mean that previously purchased educational content was inaccurate or that a refund is automatically owed. Purchase-specific rights already provided for a completed transaction will not be retroactively removed except where permitted by the applicable purchase terms or law. 25. CHANGES TO THESE TERMS TradesByTru may update these Terms periodically to reflect changes to its Services, products, platforms, business practices, or legal obligations. The updated version will be posted where these Terms are made available and will display a revised "Last updated" date. Your continued use of TradesByTru after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law. 26.
