TERMS OF SERVICE FOR TRADESBYTRU HQ Last updated: June 17, 2026 Welcome to TradesByTru HQ, also referred to as “TBT HQ,” “TradesByTru,” “we,” “us,” or “our.” These Terms of Service govern your purchase, membership, access to, and use of the TradesByTru HQ website, private community, live trading content, real-time market commentary, setups, educational alerts, videos, posts, messages, trade reviews, downloads, and related products or services collectively referred to as the “Services.” By purchasing a membership, creating an account, joining the community, accessing paid content, or otherwise using the Services, you agree to these Terms of Service and acknowledge our Privacy Policy. If you do not agree to these Terms, do not purchase, join, access, or use the Services. 1. ELIGIBILITY TradesByTru HQ is intended only for adults who are at least 18 years old. By purchasing or using the Services, you represent that: • You are at least 18 years old • You have the legal capacity to enter into this agreement • The information you provide is accurate and current • Your use of the Services does not violate applicable law • You are not prohibited from accessing trading-related educational content in your location You are responsible for determining whether the Services are legally available to you. 2. EDUCATIONAL AND INFORMATIONAL CONTENT ONLY TradesByTru HQ provides general educational and informational trading content. Nothing provided through TradesByTru HQ constitutes: • Financial advice • Investment advice • Personalized trading advice • Commodity trading advice • Legal advice • Tax advice • Accounting advice • Brokerage services • Investment management • Account management • A recommendation or solicitation to buy, sell, hold, or trade any financial product Content may include live trading, personal market observations, market structure, setups, key levels, trade plans, educational alerts, entries and exits, trade reviews, risk discussions, trading psychology, and personal trading-journal content. All content reflects general educational commentary or the personal decisions and experiences of TradesByTru. It is not tailored to your financial situation, experience, objectives, account size, broker, risk tolerance, or personal circumstances. 3. REAL-TIME CONTENT, SETUPS, AND ALERTS TradesByTru HQ may provide real-time or near-real-time: • Live trading sessions • Market commentary • Educational setups • Key levels • Trade plans • Watchlist observations • Entry or exit discussions • Risk-management discussions • Alerts concerning market conditions or important zones This content is provided for educational and informational purposes only. Real-time content is not an instruction requiring you to enter, exit, copy, mirror, or manage a trade in any particular way. You are solely responsible for deciding: • Whether to trade • Whether a setup is appropriate for you • When to enter or exit • What product or broker to use • What position size to use • Whether to use a stop loss • How much money to risk • Whether you understand the applicable instrument You should not assume that TradesByTru will announce every entry, exit, adjustment, stop, target, or personal trading decision. Market conditions can change quickly. Content may be delayed, incomplete, edited, unavailable, misunderstood, or received after a market move has occurred. 4. NO GUARANTEED NUMBER OF TRADES OR SETUPS Membership does not guarantee that a trade, setup, alert, or live session will occur on any particular day. TradesByTru may decide that market conditions do not support a trade. Unless a specific membership offer expressly states otherwise, TradesByTru HQ does not guarantee: • A minimum number of trades • A minimum number of setups • Daily alerts • Daily livestreams • A particular trading schedule • A particular holding period • Continuous market coverage • Coverage of every New York trading session • Coverage during holidays, travel, illness, technical interruptions, or personal time off A day without a trade, alert, or setup is not a failure to provide the membership service. 5. NO GUARANTEES OR INCOME PROMISES Trading involves substantial risk. TradesByTru HQ does not guarantee: • Profits • Income • Payouts • Account growth • Trading consistency • A specific win rate • Funded-account approval • Successful evaluations • Retention of a funded account • Prop-firm payouts • Recovery of membership fees • Replacement of employment income • Achievement of any specific financial goal • Achievement of the same results shown by TradesByTru or another member You may lose some or all of the money you trade. Depending on the product, broker, leverage, and market conditions, losses may exceed the amount initially deposited. Past performance is not indicative of future results. 6. PERFORMANCE RESULTS, SCREENSHOTS, AND PAYOUTS TradesByTru HQ may display or discuss: • Personal trades • Winning or losing trades • Profit-and-loss screenshots • Brokerage or platform screenshots • Funded-account balances • Simulated account results • Evaluation results • Prop-firm accounts • Payouts • Account-growth goals • Trading statistics • Long-term financial goals These materials document personal experiences and are provided for education, transparency, commentary, or journaling. They are not promises, guarantees, forecasts, or representations of what you or a typical member will earn. Results may reflect particular market conditions, account rules, risk levels, experience, timing, products, fees, commissions, leverage, or other circumstances that may not apply to you. You should not assume that displayed results are typical or generally achievable. 7. SIMULATED, DEMONSTRATION, AND FUNDED ACCOUNTS Some content may involve: • Simulated trading • Demonstration accounts • Evaluation accounts • Funded or performance-based accounts • Prop-firm accounts • Accounts subject to special drawdown or payout rules Simulated or evaluation results may differ materially from results achieved in a personally funded live brokerage account. A funded-account balance may represent notional, simulated, conditional, or restricted buying power rather than cash personally deposited or freely withdrawable. Prop firms and funded-account providers may impose their own rules, including drawdown limits, consistency requirements, payout conditions, prohibited strategies, inactivity rules, platform restrictions, or account-termination provisions. TradesByTru HQ does not control those rules and is not responsible for a member’s evaluation failure, account closure, denied payout, rule violation, or dispute with a prop firm. 8. YOUR TRADING RESPONSIBILITY You are fully responsible for your own: • Trading decisions • Account funding • Position sizing • Risk limits • Entries and exits • Stop losses • Profit targets • Broker selection • Platform selection • Order execution • Margin requirements • Commissions and fees • Tax obligations • Prop-firm compliance • Trading results TradesByTru HQ does not place trades in your account, control your account, take custody of your funds, request brokerage passwords, or manage money for you. You should never trade money needed for rent, food, transportation, medical care, emergency savings, debt payments, or other essential expenses. You should trade only with capital you can afford to lose. 9. MARKETS AND PRODUCTS DISCUSSED TradesByTru HQ currently focuses primarily on the New York trading session and Dow-related markets, which may include: • YM futures • Micro or related futures contracts • Instruments commonly identified as US30 • Forex or CFD products connected to major United States stock indexes • Other index-related markets or products discussed for comparison or education TradesByTru may modify, expand, reduce, or change the markets covered at any time. Similar names do not mean that two products are identical. Futures, cash indexes, CFDs, spread-betting products, and broker-specific instruments can have different: • Contract specifications • Tick or point values • Margin requirements • Trading hours • Pricing • Spreads • Commissions • Expiration rules • Counterparty risks • Regulatory protections You are responsible for understanding the exact product offered by your broker or platform before trading it. 10. NO PROFESSIONAL OR FIDUCIARY RELATIONSHIP Your purchase, membership, communication, or participation does not create: • A financial adviser-client relationship • A commodity trading adviser-client relationship • A broker-client relationship • A fiduciary relationship • An attorney-client relationship • A tax adviser-client relationship • An accountant-client relationship • An employment relationship • A partnership or joint venture TradesByTru HQ is a trading-education and community service. 11. MEMBERSHIP ACCESS Membership access may be provided through: • The official TradesByTru website • A payment or checkout provider • A membership platform • Email • A private community platform • Livestream or video services • Social-media platforms • Other third-party tools selected by TradesByTru Access is personal to the purchaser and may not be transferred, shared, leased, sold, or assigned to another person. You are responsible for maintaining the security of your account, email, password, device, and platform credentials. You must promptly report suspected unauthorized access. 12. MEMBERSHIP FEATURES AND CHANGES TradesByTru HQ may add, remove, replace, pause, or modify: • Membership features • Covered markets • Community platforms • Posting schedules • Live-session schedules • Educational formats • Content libraries • Communication methods • Prices • Membership tiers • Bonuses • Tools or resources The membership may evolve as the business, trading strategy, platforms, market conditions, or member needs change. Unless otherwise required by law, changes to ordinary membership features do not create an automatic right to a refund. 13. PAYMENTS AND RECURRING BILLING The price, billing frequency, renewal terms, and included features will be presented at checkout or on the applicable offer page. Depending on the plan selected, membership may be billed: • Monthly • Annually • For another disclosed recurring period • As a one-time purchase By selecting a recurring membership and completing your purchase, you authorize the applicable payment provider to charge your selected payment method at the disclosed price and billing frequency until canceled. You are responsible for reviewing the price and recurring-payment terms before purchasing. You are also responsible for: • Maintaining a valid payment method • Reviewing billing notices • Updating expired payment information • Managing your subscription through the applicable platform • Canceling before the next renewal date when you do not want another charge Taxes or platform fees may be added where applicable. 14. CANCELLATION You may cancel a recurring membership using the cancellation method provided by the checkout, payment, or membership platform. Cancellation generally stops future renewals. Unless otherwise stated, cancellation does not immediately remove access already paid for, and access may continue until the end of the current billing period. Canceling after a renewal charge has already been processed does not automatically reverse or refund that charge. Deleting an application, leaving a community, unfollowing an account, blocking a social-media page, or stopping use of the Services does not necessarily cancel billing. You must complete the applicable cancellation process. If you cannot locate the cancellation option, contact TradesByTru HQ through the official website before the next renewal date. 15. REFUND POLICY Because TradesByTru HQ provides digital content and may grant immediate access to member-only material, payments are generally non-refundable once access has been provided. Except where required by law or expressly stated in a specific offer: • Past membership payments are non-refundable • Partial-month refunds are not provided • Unused membership time is not refundable • Failure to use the membership does not create a refund right • Trading losses do not create a refund right • A day without a setup or trade does not create a refund right • Disagreement with a market opinion does not create a refund right • Cancellation does not retroactively refund prior charges If a duplicate payment, billing error, or unauthorized transaction occurs, contact TradesByTru HQ promptly so the issue can be reviewed. Nothing in this section limits any non-waivable consumer right provided by applicable law. 16. PAYMENT FAILURES AND CHARGEBACKS If a payment fails, expires, is reversed, or remains unpaid, membership access may be suspended or terminated. Before initiating a chargeback, you are encouraged to contact TradesByTru HQ to attempt to resolve the billing issue. Submitting a knowingly false, fraudulent, or abusive payment dispute may result in: • Immediate suspension or termination • Loss of access to member content • A ban from future purchases • Submission of relevant records to the payment processor • Collection or legal action where appropriate Nothing in these Terms prevents you from exercising a legitimate right to dispute an unauthorized or incorrect charge. 17. LIMITED LICENSE TO MEMBERS Subject to your payment and compliance with these Terms, TradesByTru grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-commercial license to access member content for your own education. You do not obtain ownership of the content. The license ends when: • Your membership expires • Your payment fails • You cancel and the paid access period ends • Your access is terminated for violating these Terms • The applicable content or service is discontinued 18. INTELLECTUAL PROPERTY Unless otherwise stated, TradesByTru HQ content is owned by or licensed to TradesByTru. Protected content may include: • Brand names and logos • Website text and design • Live sessions • Videos and recordings • Market commentary • Setups and trade plans • Educational alerts • Key-level discussions • Charts and annotations • Trade reviews • Written posts and messages • PDFs and downloads • Templates • Lessons and course materials • Community resources • Graphics and promotional materials No ownership rights are transferred to members. 19. NO COPYING, RECORDING, SHARING, OR RESELLING Without prior written permission, you may not: • Record livestreams or calls • Screen-record member content • Repost paid content • Copy or reproduce paid materials • Share screenshots of private content • Forward alerts or messages • Share login credentials • Allow another person to use your membership • Upload content to another community • Publish content on social media • Resell, sublicense, or distribute materials • Use member content to operate a competing service • Train an artificial-intelligence system using paid content • Remove copyright, branding, or ownership notices • Commercially exploit TradesByTru content Unauthorized sharing may result in immediate termination without refund and may lead to additional legal remedies. 20. MARKET DATA AND THIRD-PARTY CONTENT Charts, prices, quotes, platform screens, news, and market data may originate from third-party brokers, exchanges, charting platforms, or data vendors. Market data may be: • Delayed • Inaccurate • Incomplete • Subject to outages • Different across brokers • Subject to licensing restrictions • Corrected after publication TradesByTru HQ does not grant you a license to redistribute third-party market data. You are responsible for complying with the terms of your broker, exchange, charting provider, prop firm, and data provider. 21. MEMBER CONTENT AND COMMUNITY POSTS You retain ownership of original content you voluntarily post in the community. By posting content, you grant TradesByTru HQ a limited, non-exclusive license to host, store, display, reproduce, and moderate that content as reasonably necessary to operate the community and Services. You represent that you have the right to post the material and that it does not violate another person’s rights. Do not post: • Brokerage login credentials • Account numbers • Bank information • Payment-card details • Authentication codes • Private keys or seed phrases • Another person’s confidential information • Copyrighted content you do not have permission to use TradesByTru may remove member content that violates these Terms or creates legal, security, privacy, or community concerns. 22. TESTIMONIALS AND MEMBER RESULTS TradesByTru HQ may request permission to feature a member’s voluntary review, testimonial, feedback, or trading-related experience. TradesByTru will not knowingly publish a member’s private submission as promotional content without permission. Member testimonials and results reflect individual experiences and do not guarantee or establish what another person will achieve. Members may not submit fake, misleading, purchased, fabricated, or impersonated testimonials. 23. COMMUNITY CONDUCT Members must communicate respectfully and use the community lawfully. You may not: • Harass, threaten, stalk, or intimidate others • Use hateful or discriminatory language • Post sexually explicit or violent material • Scam or defraud members • Impersonate another person or business • Spam the community • Promote unrelated products without permission • Solicit members for competing services • Share malware, phishing links, or harmful files • Manipulate or falsely represent trading results • Leak private community content • Disrupt livestreams, discussions, or member access • Encourage illegal activity • Violate platform rules or applicable law TradesByTru may moderate content and remove members who interfere with the safety, integrity, or intended purpose of the community. 24. THIRD-PARTY PLATFORMS TradesByTru HQ may depend on third-party providers for: • Website hosting • Payments • Subscription management • Email • Community access • Livestreaming • Video hosting • Analytics • Charting • Market data • Social media • Customer support TradesByTru does not control and is not responsible for third-party: • Outages • Delays • Data loss • Account restrictions • Policy changes • Security incidents • Payment holds • Pricing changes • Platform errors • Broker execution • Prop-firm decisions • Removal of third-party features Your use of third-party platforms may be governed by separate terms and privacy policies. 25. SERVICE AVAILABILITY TradesByTru HQ does not guarantee that the Services will always be uninterrupted, secure, current, error-free, or available on every device. Access may be interrupted because of: • Maintenance • Technical failures • Internet outages • Platform outages • Market-data failures • Power interruptions • Cybersecurity events • Illness or emergencies • Travel • Platform policy changes • Events outside TradesByTru’s reasonable control When practical, TradesByTru may use a reasonable alternative platform or delivery method, but is not required to guarantee uninterrupted access. 26. SUSPENSION AND TERMINATION TradesByTru may suspend or terminate access when a member: • Violates these Terms • Shares or resells private content • Shares login access • Fails to pay • Engages in fraud • Submits an abusive or fraudulent chargeback • Harasses members or staff • Misuses the platform • Creates security or legal risk • Violates third-party platform rules • Disrupts the community • Uses the Services unlawfully Termination for a Terms violation may occur without refund. TradesByTru may also discontinue the Services or a membership plan. When appropriate, affected members may receive notice, continued access through a stated date, replacement access, or another remedy selected by TradesByTru and consistent with applicable law. 27. TRADING RISK DISCLOSURE Futures, forex, CFDs, index-related products, and leveraged trading involve substantial risk and are not suitable for every person. Leverage can magnify gains and losses. Market conditions may result in: • Slippage • Gaps • Rejected orders • Delayed fills • Partial fills • Wider spreads • Platform failures • Margin calls • Forced liquidation • Losses exceeding intended risk • Loss of some or all trading capital Stop-loss orders do not guarantee execution at the selected price. Before trading, you should independently evaluate the product and consult an appropriately qualified professional when necessary. 28. DISCLAIMER OF WARRANTIES To the fullest extent permitted by law, the Services are provided “as is” and “as available.” TradesByTru HQ makes no express or implied warranty regarding: • Accuracy • Completeness • Timeliness • Reliability • Availability • Profitability • Fitness for a particular purpose • Merchantability • Non-infringement • Compatibility with your trading strategy • Suitability for your financial circumstances TradesByTru does not warrant that the Services will produce a particular result or prevent trading losses. Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you. 29. LIMITATION OF LIABILITY To the fullest extent permitted by law, TradesByTru HQ, TradesByTru, and their owners, contractors, service providers, affiliates, and representatives will not be liable for: • Trading losses • Investment losses • Lost profits • Lost opportunities • Missed trades • Delayed trades • Slippage • Account liquidation • Failed evaluations • Funded-account termination • Denied payouts • Broker or prop-firm disputes • Platform outages • Market-data errors • Unauthorized account access not caused by TradesByTru’s legally actionable conduct • Emotional distress arising from trading • Reliance on educational content • Indirect, incidental, special, consequential, exemplary, or punitive damages To the fullest extent permitted by law, the total liability arising from the Services will not exceed the amount you paid to TradesByTru HQ during the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded or limited. 30. INDEMNIFICATION To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless TradesByTru HQ, TradesByTru, and their owners, contractors, affiliates, service providers, and representatives from claims, liabilities, losses, damages, costs, and reasonable expenses arising from: • Your trading decisions • Your misuse of the Services • Your violation of these Terms • Your infringement of another person’s rights • Your violation of broker, exchange, prop-firm, or platform rules • Content you post or distribute • Unauthorized sharing of member-only content • Fraudulent or unlawful conduct This obligation does not apply to the extent a claim resulted from conduct for which indemnification cannot legally be required. 31. ELECTRONIC COMMUNICATIONS By using the Services, you consent to receive electronic communications relating to: • Your account • Purchases • Billing • Membership access • Security • Support • Policy updates • Service changes • Community announcements Communications may be delivered through email, website notices, checkout platforms, membership platforms, or community messages. You are responsible for keeping your contact information current. 32. GOVERNING LAW AND VENUE These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. ASSIGNMENT You may not assign or transfer your membership, account, or rights under these Terms without written permission. TradesByTru may assign these Terms as part of a business transfer, restructuring, merger, sale, or transfer of assets, subject to applicable law. 36. ENTIRE AGREEMENT These Terms, the Privacy Policy, the applicable checkout terms, and any clearly disclosed offer-specific conditions constitute the entire agreement concerning your use of the Services. If an offer-specific term directly conflicts with these general Terms, the offer-specific term controls only for that offer. 37. CHANGES TO THESE TERMS TradesByTru HQ may update these Terms to reflect changes in: • Membership services • Business practices • Covered markets • Technology • Third-party platforms • Payment practices • Legal or regulatory requirements The revised Terms will be posted where these Terms are made available and will include an updated revision date.
